Substantiation of the Hypothesis on the Imitational Nature of Implementation the Principle of Legality in the Activities of the Russian Police

The article is devoted to the substantiation of the scientific hypothesis about the imitational nature of the implementation of the principle of legality in the activities of the Russian police. For this purpose, the correlation between the principle of legality and the actual rules relating to the police service, as well as official activities, is analyzed. The study found that there are two informal norms that impede the implementation of the principle of legality in the police activities. The first such rule concerns the police service and can be formulated as follows: "Loyalty to the bosses precedence over the legality of the activities". The second one relates to police activities and may be formulated as follows: "For official purposes, a reasonable violation of the law is permissible". Thus, police officers who exclude the possibility of violations of the law in their activities are in a discriminatory state. At the same time, special efforts are made in the police to ensure that the formal indicators of its activities correspond to the indicators of compliance with the principle of legality. On the basis of this, the authors of the article formulate a hypothesis that the implementation of the principle of legality in the activities of the police has an imitational nature and consider it necessary to full scientific verification.
