La Cour constitutionnelle conclut que la réglementation par les dispositions de l'art. 54, al. 2 C.fam. le droit d'intenter une action enfaveur que de nier la paternité présumée présomption père, la mère et l'enfant hors né pendant le mariage, également titulaire d'un intérêt légitime à promouvoir de telles actions constituent une violation du principe d'égalité inscrit Art. 16, al. 1 de la Constitution. Ce qui prédomine dans ce contexte est la raison commune qui est d'assurer la prévalence de la réalité sur la fiction, peu importe les motifs particuliers ou des justifications sur les deux acteurs, père présumé que la mère et l'enfant qui ne peut se prévaloir des intérêts particuliers peut conduire à la détention comme un argument pour justifier impérative système discriminatoire de la loi établie par la critique.

The author of the communication reviewed the acts of the Romanian Parliament as being a manifestation of political will which arise rules of law or exclusively political attitudes and which are adopted as a consequence of applying various parliamentary procedures. Special attention was given to the legal acts of Parliament, laws, resolutions and motions, as expressions of the will made in order to produce legal effects and whose infringement draws the coercion force of the State.

One of the major results of the post 1989 Romanian society has been that of reassertion of the human dignity, the citizens’ rights and freedoms, as well as the free development of human personality among the fundamental values, which characterize the Romanian State. The Constitutional Court has had an essential contribution to this process. Through its activity of reforming the antinomies between the internal laws and the Constitution, it has granted priority to the international regulations referring to human rights, due to the above mentioned constitutional provisions. Between 1994 and 2003, by the approximate 380 decisions, in which the Court based a part of the passed solutions on the texts of the Convention for the defence of the human rights and fundamental freedoms, it contributed to the emphasis of the importance of these international provisions within the reference framework of the human rights legislation, and also to insure the accurate interpretation and enforcement of these regulations by the courts of law according to the constitutional provisions of article 147 paragraph (4), which ensures the compulsory character of the Constitutional Court’s decisions.
