A JUDICIALIZAÇÃO DO AFETO: ANÁLISE DA ARGUMENTAÇÃO JURÍDICA NO REsp 1.159.242/SP

A motivação das decisões proferidas pelo poder judiciário é uma garantia constitucional. Assim, na medida em que os magistrados motivam suas decisões, as razões que conduziram seu raciocínio até sua conclusão, materializada na decisão de mérito, podem ser alvo de críticas. E tais críticas, sempre serão legítimas seja qual for o posicionamento em relação a decisão proferida, pró ou contra. No entanto, a despeito de ser legítimo discordar de um posicionamento judicial no Estado Democrático de Direito, quando a análise se dá a partir de um prisma técnico, não se mostra razoável criticar apenas por criticar, sendo necessária a adoção de “uma metodologia” que permita, por meio de critérios técnicos, avaliar de fato, a qualidade da motivação levada a efeito em uma decisão. Nesse contexto o estudo das argumentações jurídicas, desenvolvidas pelos magistrados em suas decisões, por meio de metodologias sistematizadas é de fundamental importância, pois torna possível analisar e posteriormente avaliar de forma ampla e criteriosa as decisões judiciais. No presente trabalho, estuda-se, utilizando como parâmetro de análise as teorias argumentativas desenvolvidas por Stephen Toulmin, Manuel Atienza e Neil Maccormick, as argumentações levadas a efeito nos votos que culminaram na decisão final proferida no REsp 1.159.242/SP, com objetivo de avaliar a argumentação desenvolvida pelos ministros da 3ª Turma do Superior Tribunal de Justiça no julgamento do referido recurso, cujo mérito tratou da possibilidade de compensação por danos morais em decorrência do abandono afetivo. / The motivation of judgments given by the judiciary is a constitutional guarantee. Thus, as the magistrates motivate their decisions, the reasons that led their reasoning to its conclusion, materialized in the decision of merit, can be criticized. And such criticism will always be legitimate whatever the position in relation to the decision made, for or against. However, despite the fact that it is legitimate to disagree with a judicial position in the Democratic Rule of Law, when the analysis takes place from a technical perspective, it is not reasonable to criticize just for criticizing, requiring the adoption of “a methodology” that allow, by means of technical criteria, to actually evaluate the quality of the motivation carried out in a decision. In this context, the study of the legal arguments developed by the magistrates in their decisions through systematized methodologies is of fundamental importance, since it makes it possible to analyze and subsequently evaluate the judgments broadly and carefully. In the present work, the argumentative theories developed by Stephen Toulmin, Manuel Atienza and Neil Maccormick are studied, as well as the arguments carried out in the votes that culminated in the final decision issued in REsp 1.159.242 / SP, aiming to evaluate the arguments developed by the Ministers of the 3rd Chamber of the Superior Court of Justice in the judgment of the appeal, whose merit dealt with the possibility of compensation for moral damages as a result of emotional abandonment.
