O objetivo do presente estudo é compreender o sentido do artigo 394-A, da Consolidação das Leis do Trabalho, em sua redação promovida pela Lei n.º 13.467/2017, a partir de uma análise sistemática do arcabouço normativo constitucional e internacional de proteção à saúde da mulher no trabalho. Para tanto, realizou-se pesquisa documental acerca da normatização do trabalho em ambiente insalubre da mulher gestante ou lactante, bem como das justificativas utilizadas para embasar as alterações legislativas quanto ao tema. Realizou-se, ainda, revisão bibliográfica sobre o direito fundamental à saúde no trabalho, bem como sobre os potenciais danos às trabalhadoras gestantes e lactantes em decorrência da exposição a agentes insalubres, ancorada em pesquisas na área das ciências da saúde,especificamente quanto aos ruídos e agentes químicos. Problematizou-se, ainda, a expressão “médico de confiança”,prevista na atual redação do artigo 394-Ada Consolidação das Leis do Trabalho,assim como a possibilidade de enquadramento negocial do grau de insalubridade, em contraponto àsnormas e diretrizes que respaldam a imperatividade de análise técnica especializada quanto a temas referentes à saúde no trabalho. A partir deste estudo, concluiu-se que a alteração introduzida no ordenamento jurídico por meio do novo artigo 394-A da Consolidação das Leis do Trabalho é mais um sintoma do que foi a reforma trabalhista: a vulnerabilização das trabalhadoras frente ao poderio econômico por meio da flexibilização de normas, da prevalência do negociado sobre o legislado e da transferência da responsabilidade sobre a saúde laboral da trabalhadora para a própria trabalhadora, em afronta às diretrizes da Constituição Federal de 1988. / The objective of this study is to comprehend the meaning of article 394-A of the Consolidation of Labor Laws, in its wording given by Law n. 13.467/2017, from a systematic analysis of the constitutional and international normative framework of women’s occupational health protection. To reach that goal, a documental research was made surrounding the rules about pregnant or lactating women’s labor at unhealthy environments, as well as surrounding the justification used to base legislative amendments concerning the subject matter. Subsequently, a bibliographical review followed regarding the fundamental right to health at work environment, as well as the potential damages to pregnant and lactating workers due to exposition to unhealthy agents, anchored in health science researches, specifically concerning noises and chemical agents. Furthermore, the expression “trustworthy doctor” was problematized, foreseen by the current wording of article 394-A of the Consolidation of Labor Laws, as well as the possibility of negotiating the framework of the degree of unhealthiness, in opposition to the rules and guidelines that back up the imperativeness of a technical analysis of themes relative to occupational health. From this study, it was concluded that the alteration introduced to the legal order by means of the new article 394-A of the Consolidation of Labor Laws is another symptom of what the labor reform brings: the crippleness of workers in comparison to the economic power due to legal relaxation, the prevalence of negotiated in detriment of legislated, and the transference of responsibility over women’s occupational health to the worker herself, in affront to the guidelines of Federal Constitution of 1988.
