E repugna, porque todas as normas constitucionais originárias retiram sua validade do Poder Constituinte originário e não das normas que, também integrantes da mesma Constituição, tornariam direito positivo o direito supra positivo que o constituinte originário integrou à constituição ao lado dos demais e sem fazer qualquer distinção entre esta e aquelas.
