The aim of this paper is to reconstruct the experience a group of minors went through when they were deprived of their freedom by the Capital police by the end of 19th century and early decades of the 20th century. This paper also aims at understanding how and why the life of a large group of working class minors and young people was shaped by the imprisonment experience in the police premises. Apart from listing the specific features which characterized the life of these minors in these premises, this work aims at mentioning the reasons why children who have committed minor crimes and offenses spent their days there, as well as orphans and abandoned children. The hypothesis which frames this work stems from the close connection between the way the justice of minors functioned–when there was no specific legal jurisdiction– and the role the police played in the bureaucratic-administrative assistance network for the “abandoned and criminal” children of that period.

This work is set in the proposal of starting a conceptual delimitation of the penalty goberment, which determines the process of penitenciary institution. This indicates the way in which social, economic and political processes have been defining punitive behaviour. What it is pretended to do is to posibilitate the dialogue with the techniques that have been unfolding through history, and to delimitate the way in which this has been done under the influence of certain interests. Delimiting which were the interests that have motivated the evolution of punitive imprisonment or in which way those interests have influenced in its transformation will allow us to analyze the significance and purposes of the punitive methods had in history and the preservation of their current validity. Proposes to know, on the one hand, which type of identification has the beginning of the productive process and the need to discipline and regulate the population with the penlaty production; and on the other hand, how the knmowledge of methosds administrating prison sentence was determined independently of the limits the very same modern criminal rights will establish the proper functioning of the punitive behavior (legality, proportional, the humanity of the sentence, etc.).

The right to marriage is regulated in article 32.1 of the EC which says: “the man and the woman have the right to contract marriage with full legal equality,” differentiating, the Constitution, between marriage and protection of the family, regulated, the latter, in article 39, under the rubric of guiding principles of Social and economic policy protection that is given to the family regardless of that the same has been generated through marriage or not. It is vital the right in question since, with it, you can get a greater chance of social reintegration of prisoners or, at least, a better approach to it, the estrangement of family relationships is essential in the process of not dismantling and, therefore, in the new social reintegration.
